About the Program:
This month’s program is a panel of experts discussing Alternative Dispute Resolution.
Kristen Blankley (and others) will provide an overview of the alternative dispute process (as it applies to human resource administrators). Kristen will also outline the pre-dispute and post-dispute best practices for success in the alternative dispute resolution process. Pam Bourne (and others) will discuss employment law cases and will outline practical tips for human resource administrators to keep in mind during the alternative dispute resolution process. Finally, Dave Hubbard will outline all the services that the Mediation Center provides which would be helpful to know from a human resource perspective.
Kristin Blankley, Assistant Professor of Law at UNL College of Law:
Professor Blankley joined the faculty in 2010. She received her B.A. in History and Political Science and graduated summa cum laude from Hiram College, and she received her J.D. from The Ohio State University, Mortiz College of Law, graduating first in her class. After law school, Professor Blankley clerked for the Honorable Eugene E. Siler on the Sixth Circuit Court of Appeals and the Honorable Kermit E. Bye on the Eighth Circuit Court of Appeals. Following her two appellate clerkships, Professor Blankley practiced at the Columbus, Ohio office of Squire, Sanders & Dempsey, LLP. Her practice involved a wide variety of civil litigation matters, including cases involving the First Amendment, trade secrets, contract issues, and product liability.
Professor Blankley teaches Alternative Dispute Resolution, Advocacy in Mediation, Mediation, and Arbitration. She first became interested in the field while in law school, where she earned a Certificate in Dispute Resolution. Her research has largely focused on how parties can customize alternative processes to suit their dispute-resolution needs. Her research also deals with the crossroads of alternative dispute resolution and legal ethics. Professor Blankley is an active member of the American Bar Association Section of Dispute Resolution, regularly speaking at their annual meeting. Additionally, she serves on the American Bar Association Law School Division Arbitration Competitions Committee, which oversees the annual law school Arbitration Competition. Professor Blankley is also a practicing mediator in Nebraska.
Professor Blankley also instituted and coaches the Nebraska Law College Representation in Mediation Competition for students. This competition teaches students how to be effective advocates for their clients in mediation. Professor Blankley runs an intra-school competition and then travels with the winning students to compete against students from other schools.
Professor Blankley sits on the Board of Directors of both The Mediation Center and the Nebraska Mediation Association. She is also on the Parenting Act Evaluation Advisory Counsel, a group that is assessing the success of mediation of parenting time disputes in Nebraska. Professor Blankley currently sits as a co-chair of the American Bar Association Section of Dispute Resolution Subcommittee on Ethics.
Dave Hubbard, Director of Facilitation and Training at The Mediation Center:
David serves as the Director of Facilitation and Training at The Mediation Center. He is an experienced attorney who, prior to joining the staff at The Mediation Center, practiced law for many years, was a business executive, as well as a private-practice mediator and facilitator. In addition to his full-time position at the Center he serves as an adjunct undergraduate professor, adjunct faculty member at UNL College of Law, is approved as a local rule 4.3 mediator in Douglas County, and is approved as a federal mediator. David’s mediation and facilitation skills have been refined through hundreds of hours of training through the likes of Harvard’s Program on Negotiation, Federal Mediation and Conciliation Service, American Bar Association, and hundreds of mediations and facilitations. David is a member of ASTD and an Executive Committee Member of the Alternative Dispute Resolution section of the Nebraska State Bar Association.
Pamela Bourne, Attorney at Woods & Aitken:
Pam Bourne represents management exclusively on workplace legal issues. Her main focus is on preventative employment law issues. Pam’s goal is to help clients prevent employment claims from arising and to advise on HR strategies that will result in a sound defense position should a claim occur. In connection with this goal, Pam provides day-to-day counseling on a variety of employment issues (e.g., hiring, E-Verify, I-9 compliance, discipline, discharge, performance evaluations, employment-related contracts, FMLA, ADAAA, harassment, discrimination, wage/hour, state employment laws, and other areas). Pam also prepares and assists clients in developing HR policies and handbooks and conducts training for clients on a broad range of topics (e.g., how to avoid harassment and retaliation claims).
In addition, she frequently defends employers in connection with employment-related claims filed with government agencies. Pam earned both her law degree and Master of Business Administration degree in 2000 from the University of Nebraska. Her educational background allows her to deliver practical, results driven, advice to her clients.
