The New Overtime Rule—Are you Ready?

Lunch Presentation Description:
The U.S. Department of Labor recently announced its final rule to make an estimated 1.3 million American workers eligible for overtime pay under the Fair Labor Standards Act of 1938. The new rule will become effective January 1, 2020. Is your organization ready? Rembolt Ludtke employment law attorneys Mark Fahleson and Tara Paulson will discuss the history of the FLSA, the new requirements under the final rule, and strategies to help avoid an audit or lawsuit in the coming months.

Workshop:
The Fair Labor Standards Act—It’s Over 80 Years Old and Chances Are You Are Still Violating It.

The law has been around for over half a century, yet it is estimated that over 60 percent of employers are in violation of some provision of the FLSA. The afternoon session will give attendees a chance to learn about recent FLSA developments and opinion letters and will include law school-type hypotheticals to help foster a greater understanding of the complexities of the FLSA and what is required for compliance.

This program & workshop is valid for 3 PDCs toward SHRM-CP and SHRM-SCP recertification.

Presenters

Mark Fahleson is a partner with Rembolt Ludtke LLP where his practice centers on employment and labor law. Fahleson also serves as an adjunct professor teaching Employment Law and Employment Discrimination at the University of Nebraska College of Law. Fahleson’s zealous yet cost-effective representation has resulted in numerous successful verdicts from federal and state court judges and juries. Fahleson’s expertise and skill have earned him recognition, including being named as the Employment Law (Management-Side) Attorney 2019 “Lawyer of the Year” for Lincoln by The Best Lawyers in America©.

Tara Paulson is a partner at Rembolt Ludtke LLP where her practice primarily focuses on employment and labor issues and civil litigation. Paulson has significant experience in employment litigation, including matters involving federal, state, and local employment laws. In addition to her litigation practice, Paulson regularly represents clients in responding to administrative charges before federal, state, and local agencies, counsels employers regarding various labor and employment law issues, negotiates and prepares employment and separation agreements, reviews and revises employee handbooks, and drafts personnel policies. Paulson, a Lincoln native, has a demonstrated ability to identify and lead matters effectively, manage projects according to budget and implement improvements to help businesses succeed. She is recognized by clients and peers for anticipating needs, an acute attention to detail, a strong work ethic and her ability to develop strong business relationships.

Toys for Tots Campaign
In support of our annual Toys for Tots campaign, we are asking LHRMA members to bring an unwrapped toy to the November 12th meeting at the Isles Reception Hall. Toys should be purchased for kids up to age 12.
