Injunction on FLSA Salary Cut-Off

Just ten days before the implementation date, a federal judge in Texas issued a preliminary injunction to block enforcement of the Department of Labor’s (DOL’s) new federal overtime rule, which would have doubled the Fair Labor Standards Act’s (FLSA’s) salary threshold for exemption from overtime pay. The preliminary injunction will likely be appealed to the Fifth Circuit Court of Appeals.

If the decision is reversed by the Fifth Circuit, and an employer has not been in compliance on the December 1st effective date, a question arises whether the existence of the preliminary injunction precludes any liability between the December 1, 2016 effective date and the date the Court of Appeals issues its decision.
